MarkoMetrics provides digital marketing and SEO services as outlined in individual proposals, onboarding documents, and service agreements. The exact scope of services, deliverables, timelines, and responsibilities are defined on a per-engagement basis and confirmed in writing before execution begins.
Any services not expressly included in the confirmed scope are considered out of scope and will require separate discussion and approval.
Services will commence only after commercial terms have been agreed upon, onboarding documentation has been confirmed, and the initial payment has been received, unless otherwise agreed in writing. MarkoMetrics reserves the right to delay or pause work if required information, access, approvals, or payments are not provided in a timely manner.
Clients agree to provide accurate, complete, and timely information necessary for service delivery, including access to relevant platforms, tools, and systems where applicable. Clients are responsible for maintaining one primary point of contact and providing timely feedback and approvals to avoid delays in execution.
MarkoMetrics shall not be responsible for delays or performance issues arising from incomplete information, restricted access, or delayed client responses.
Fees, billing cycles, and payment terms are governed by the approved pricing proposal associated with the engagement. Payments are due as specified in the proposal and are non-refundable once work has commenced, unless otherwise stated in writing.
MarkoMetrics reserves the right to suspend services in the event of delayed or non-payment.
SEO and digital marketing outcomes depend on multiple external factors beyond MarkoMetrics' control, including search engine algorithms, market conditions, competition, and client-side factors. As such, MarkoMetrics does not guarantee specific rankings, traffic levels, leads, or revenue outcomes.
Performance is evaluated based on execution quality, agreed performance indicators, and trends over time, as discussed during onboarding and kickoff discussions.
Unless otherwise agreed in writing, all original materials, strategies, documents, and deliverables created by MarkoMetrics remain the property of MarkoMetrics until full payment has been received. Upon full payment, clients are granted the right to use deliverables solely for their internal business purposes.
MarkoMetrics retains the right to reuse general methodologies, frameworks, and non-confidential learnings across engagements.
Both parties agree to maintain the confidentiality of any non-public information shared during the engagement. Client data is accessed and processed solely for the purpose of delivering agreed services and in accordance with our Privacy Policy and onboarding documentation.
MarkoMetrics does not assume ownership of client data and acts only as a service provider for such data.
Service delivery may involve the use of third-party tools, platforms, or services. MarkoMetrics is not responsible for the availability, functionality, or policies of third-party platforms, nor for changes made by such providers that may affect performance or access.
To the fullest extent permitted by law, MarkoMetrics shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of our services or website. Our total liability for any claim shall not exceed the fees paid by the client for the services giving rise to the claim.
Either party may terminate an engagement in accordance with the termination terms outlined in the applicable service agreement or onboarding documentation. Upon termination, all outstanding fees become immediately payable, and access to services may be discontinued.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MarkoMetrics is registered, without regard to conflict of law principles.
MarkoMetrics reserves the right to update or modify these Terms at any time. Updates will be effective upon posting on the website. Continued use of the website or services constitutes acceptance of the revised Terms.
